Latest SB 435 Update
We, the motorcyclists of California enjoyed a minor victory yesterday, Tuesday September 22, in the Los Angles City Council chambers. As you may know SB 435 author Senator Pavley pestered the Council to pass a resolution in support of her worthless Legislation. The Council was actually on its way to do her bidding when John Paliwoda got wind of it and leaped into ACTION and alerted ABATE PAC. In a little less than 2 weeks we got info out to the ridding community and got calls, e-mail, and Fax's flooding into the Council's offices. According to eye witness "Sporty" former State Senator and current Councilmen Alercon made a passioned speech against the resolution as did Councilman Zine. The resolution went down in Glorious flames while about 10 of our own roasted marshmallows on the pyre. Out of the 10 who showed up to bear witness in the Council, 5 were allowed to state their case against the resolution before the vote. This is a small victory in a greater war and we need to be vigilant as Ms Pavley may come to the City Council near you next for some support. KEEP YOUR EYES AND EARS OPEN!

     As you read below you can see that the LA City council is about to endorse SB 435. I actually remember walking precincts for Mr. Alercon. I suggest faxing each Council member, e-mail next, then call. WE MUST ACT NOW!

A simple note will do like:

   Dear Councilman !?!?*#@)!?:

     As someone who travels through Los Angles and does considerable business in the area I strongly resent the honored Council endorsing this needless expensive, and intrusive Legislation. If all motorcycles were removed from the road it would be scientifically impossible to measure the difference in air quality. I am sure the L.A. City Council has more pertinent pending matters.

                                                  

Or write your own just be polite. I am including with mine the talking points bulletin we had last spring. Though we are not of the L.A. area this will not help our cause.

ABATE Members:

Our old (good) friend, former Senator Richard Alarcon (D–San Fernando Valley) is coauthoring a Los Angeles City Council resolution to support SB 435, the smog check bill for motorcycles. Maybe he doesn't realize that it's not in our best interest?

I think Local 1 should start e-mailing, faxing and telephoning all of the members of the Los Angeles City Council, since the vote is set for Friday. Our (former and hopefully current) friends are Dennis Zine, Tom Labonge (Peter D knows him well), Tony Cardenas, and possibly Greig Smith.

They are going to be voting on a resolution to support SB 435 with the smog test language in it, not the bill that got out of the Senate with the smog testing provisions removed.

I told you, all along, and in the last Bailing Wire, that SB 435 is still a smog test bill for motorcycles. It looks like Pavley is going around to get a list of cities and counties that will get a resolution supporting motorcycle smog checks, and then renege on her commitment to remove the smog tests, saying that she has all this new support from cities.

Somebody needs to oppose the resolution on Friday at the LA City Council meeting.

ITEM NO. (11) - Motion Required 09-0002-S95 COMMUNICATION FROM THE CHIEF LEGISLATIVE ANALYST and RESOLUTION (GREUEL - ALARCON) relative to the City's position on SB 435 (Pavley), which would include model-year 2000 and newer motorcycles in the smog check program. Recommendation for Council action, SUBJECT TO THE CONCURRENCE OF THE MAYOR: ADOPT the accompanying RESOLUTION to include in the City's 2009-10 State Legislative Program SUPPORT of SB 435 (Pavley), which would require the Bureau of Automotive Repair to include model-year 2000 and newer Class III motorcycles in the biennial smog check program. Fiscal Impact Statement: None submitted by the Chief Legislative Analyst. The City Administrative Officer has not completed a financial analysis of this report.
